1. Status and Business Structure

1.1.  The 'Soho Vocal Tuition' website is managed by Soho Vocal Tuition Limited (‘SVT’) which acts solely as booking and marketing agent for Anna Stubbs and Ed Staunton (‘teacher’). The expression ‘we’, ‘our’ and ‘us’ refers to the teacher and/or SVT.

1.2.  All bookings through the website constitute a contract with the teacher, each of whom is self-employed and carries out private lessons in their own name.

1.3.  Any payments made through the website or subsequently, if held by SVT, are held for and on behalf of your respective teacher.

1.4.  These conditions apply to all bookings (whether or not a lesson ensues) and to each contract between the student and the teacher. The expression ‘you’ and ‘your’ refers to the student.

2. Data Protection

2.1.  Your personal details will be held in the strictest confidence in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 (DPA 2018) and will be accessible only to SVT and the teacher. We will never pass on your data.

2.2.  By using the SVT website and booking forms, you explicitly give to SVT, and the teacher, consent to use any data that you enter for internal purposes only.

2.3.  Right to Access: at any time you are able to request a copy of your personal data from us, free of charge, in an electronic format.

2.4.  Right to be Forgotten: at any time you have the right to have SVT and / or your teacher erase your personal data, cease further dissemination of the data, and potentially have third parties halt processing of the data. However, you must have no outstanding unpaid lessons or any other outstanding business with us for us to proceed.

3. Booking Policy and Payments

3.1. Lessons

3.1.1.  The contents of each lesson, or series of lessons, will be agreed with your teacher.

3.1.2.  Each lesson will last for not less than 55 minutes, so as to allow for student changeover.

3.1.3.  Lessons and fees are non-transferable between teachers.

3.1.4. Your teacher reserves the right to decline to offer their services at any time and as they see fit.

3.1.5. Notwithstanding that a booking is confirmed as definite, your teacher reserves the right to reschedule lessons in order to accommodate others or in accordance with the above provisions.

3.2 Non-Adult Students (Children)

3.2.1.  Students under the age of 16 must be accompanied by an adult (over 18) at all times during the lesson. We may ask for age verification. Please check with your teacher before booking.

3.2.2.  The nature of vocal technique means that lessons may not be suitable for children under the age of 12. Please check with your teacher before booking.

3.3. Disabilities

3.3.1. We regret that the teachers are unable to accept students with some disabilities as we may not be able to provide access to studios or a safe environment. Please contact us prior to booking in case of query.

3.4. Cancellations, Reschedules, and Cancellation Payments.

3.4.1.  Notification of cancellation or reschedule of previously booked lessons must be received by us not less than 48 hours before the agreed start time for the lesson; or payment will remain due.

3.4.2.  Lessons cancelled or rescheduled with less than 48-hours' prior notice, or missed, will be charged at the full lesson rate, and where we hold your card details, we shall make the appropriate debit charge.

3.4.3.  Notification of cancellation or reschedule can be made by phone (including voicemail), email or text. The time stamped on the sent or received message will be used in calculation of the notice period.

3.4.4.  No refunds will be made, regardless of the circumstances, for missed lessons (including those which cannot proceed owing to ill health).

3.4.5.  The teacher and/or SVT reserves the right, without giving reasons, to cancel or reschedule any future bookings. Where applicable, reimbursement for any unused lessons already paid for will be made by direct credit to the debit card account provided or by bank transfer.

3.5 Prices and Payments

3.5.1.  Discount packages are only valid for one year and lessons bought as part of them cannot be used after the package expiry date.

3.5.2.  The price of each lesson or discount package of six lessons shown on the website at the time of your booking will be honoured.

3.5.3.  Each six-lesson discount package must be paid in full at the time of the first lesson in a series; otherwise, the individual non-discounted lesson rates apply.

3.5.4.  Payments may be made by card, bank transfer in advance of the lesson.

3.6 Gift Vouchers

3.6.1.  Gift vouchers are valid for 12 months from date of issue or as indicated on the voucher. Lessons must be taken before the expiry date.

3.6.2. Gift vouchers are non refundable.

3.6.3.  If you have a gift voucher, you must contact your teacher before booking your lesson to indicate you have a gift voucher, otherwise payment may be taken again upon registration and booking.

3.7. Health

3.7.1.  You must declare any adverse health conditions to your teacher before beginning the lesson. You are otherwise deemed to declare that you are in good health.

3.7.2.  Your teacher reserves the right to discontinue a lesson if - in their opinion - a student is too young or unfit or not well enough to sing.

4. Limitation of Liability

4.1.  Whilst we shall do our best in providing techniques and structured practice which have proved – in others – to improve their singing, we give no warranty that, as a result of the lessons, you will be able to sing at all or to sing better than at the start of the lessons.

4.2.  We shall not conduct any medical tests as to the suitability of any student to learning to sing. You agree to participate in singing lessons voluntarily, and, unless you tell us otherwise, we shall assume that you are in good health.

4.3.  Whilst your teacher will endeavour to ensure that no exercises or vocal instruction given will cause injury or pain, using poor technique or excessive misuse of the voice may during or outside of your lesson may cause injury. You are responsible for telling your teacher if you experience any pain or discomfort during your lessons.

4.4.  In particular, students must understand that there is an increased risk of injury or vocal damage in singing or performing any of the given exercises while ill or recovering from illness, particularly if such illness is of the vocal tract and airways.

4.5.  Neither SVT nor your teacher will be liable to you for any pain, injury or vocal damage brought about during or in exercises following a lesson.

4.6.  Lessons take place in a recording-studio type environment with wires and cables and also steps and other hazards. You are responsible for your own safety and must take care.

4.7.  In the unlikely event that we cancel or curtail a lesson for any reason, our liability will be limited to the price of the lesson. Where possible, we shall offer you an alternative lesson at a later date and time. We shall not be liable for any consequential loss resulting from any cancellation.

4.8.  In any case where SVT or an individual teacher is shown to have been in breach of contract or to have been negligent, our liability shall be limited to the value of the lesson(s) bought or the sum of £1,000, whichever is the greater.

5. Notifications and Law

5.1.  Neither SVT nor the teacher will be liable to you or be deemed to be in breach of contract by reason of any delay in performing, or any failure to perform, any obligations, if the delay or failure was due to any cause beyond our reasonable control, e.g. a force majeure.

5.2.  Notifications sent to us must be by email to your teacher or to the bookings email address you receive bookings confirmations form and will be deemed to be received when acknowledgement is sent.

5.3.  The validity construction and performance of any agreement in consequence of the booking shall be governed by English law and the parties irrevocably submit to the non- exclusive jurisdiction of the High Court in England.
